Who we are and what these Terms govern
1.1.The wi-fi.now website ("Site") is operated by FXO Serviços em Informática Ltda., CNPJ 11.566.322/0001-19 ("FXO", "we"). These Website Terms of Use ("Site Terms") govern access and browsing of the Site and use of its content, by any person ("you").
1.2.These Site Terms do not govern use of the Wi-Fi.now platform. Platform engagement and use are governed by the Platform Terms of Use, accepted at registration, and, where applicable, by the contract between FXO and the client, which prevails over these Site Terms on any matter relating to the service.
1.3.If you access the Site on behalf of a company, you declare that you have authority to represent it with respect to the navigation and content regulated herein.
Acceptance and amendments
2.1.By browsing the Site, you declare that you have read and agreed to these Site Terms and the Privacy Policy. If you disagree, stop browsing. These Site Terms are permanently available in a prominent location on the Site for reference at any time.
2.2.We may update these Site Terms by posting the new version on this page with the applicable effective date and maintaining a version history. Relevant changes will be highlighted. Continued browsing after the new version takes effect constitutes agreement with the revised text.
Site content and its legal value
3.1.The Site content (texts, product pages, materials, blog, FAQs, comparisons, and simulations) is exclusively informational and promotional in nature. It does not form part of FXO's contractual instruments, does not constitute a binding offer, warranty, promise of functionality, result, or regulatory compliance, nor legal, security, or privacy advice.
3.2.The scope, features, and responsibilities relating to the Wi-Fi.now platform are exclusively those described in the Platform Terms of Use, the applicable contract, and its annexes, including the technical document describing the solution's operation. In case of discrepancy between the Site content and such instruments, the contractual instruments always prevail.
3.3.Information about legislation, including Law No. 13,709/2018 (LGPD) and Law No. 12,965/2014 (Internet Civil Framework), published on the Site is generic and educational. Each client's legal compliance depends on their own assessment, and they are responsible for seeking specialized advice.
Registration and logged area
4.1.Some areas of the Site allow you to create an account, start a trial period, or access the administrative dashboard. From registration onward, the Platform Terms of Use and Privacy Policy apply, presented and accepted at that time, with the accepted version recorded.
4.2.You are responsible for the accuracy and currency of the information provided and for safeguarding and keeping confidential your credentials, and are liable for activities carried out under your account.
Intellectual property
5.1.The Site and all its content (trademarks including "Wi-Fi.now" and "FXO", logos, layout, design, texts, images, videos, source code, databases, and materials) belong to FXO or its licensors and are protected by intellectual property legislation, including Law No. 9,610/1998 and Law No. 9,279/1996.
5.2.You may view, download, and print Site content solely for personal and internal use, keeping ownership notices intact. Any other use requires FXO's prior written authorization.
5.3.Without FXO's written authorization, the following are expressly prohibited: reproducing, distributing, or commercially exploiting Site content; using FXO's trademarks, logos, or distinctive signs; employing reverse engineering, data mining, or mass automated collection (scraping) of the Site, including for competitive purposes, training computational models, or data resale; except for ordinary search engine indexing and automated reading at volumes consistent with normal browsing.
Acceptable use of the Site
6.1.By using the Site, you agree not to: (i) attempt to gain unauthorized access to systems, accounts, networks, or data; (ii) introduce malicious code, conduct denial-of-service attacks, or deliberately overload the infrastructure; (iii) circumvent, remove, or bypass security or access control mechanisms; (iv) use the Site for unlawful, fraudulent purposes or in violation of third-party rights; or (v) reproduce the Site, in whole or in part, in another environment (framing, mirroring) without authorization.
6.2.You are fully liable for any damages caused to FXO or third parties arising from violation of these Site Terms or applicable law, and agree to reimburse FXO for the duly evidenced costs, expenses, and judgments resulting therefrom, including reasonable attorney's fees awarded or confirmed in a judicial or arbitral decision.
Links and third-party content
7.1.The Site may contain links to third-party websites and services provided for convenience. FXO does not control and is not responsible, directly or indirectly, for the content, practices, policies, or products of those destinations, nor for any damages arising from their use. Access is at your own risk, and you are advised to read the terms and policies of each destination.
Site availability and disclaimers
8.1.The Site is provided "as is" and "as available". FXO does not warrant that the Site will be available uninterruptedly, securely, or free from errors, and may suspend, modify, or discontinue it, in whole or in part, at any time without notice.
8.2.To the maximum extent permitted by applicable law, FXO is not liable for damages arising from the use or inability to use the Site or its informational content, including indirect damages, lost profits, data loss, or loss of opportunity.
8.3.Nothing in these Site Terms excludes or limits liabilities that applicable law does not permit to be excluded or limited, including, where applicable, those arising from consumer protection and personal data protection legislation. The disclaimers in this clause apply to the maximum legally admissible extent, and any judicial reduction of their scope does not affect their remaining validity.
Privacy and cookies
9.1.The processing of personal data of Site visitors, including browsing data and cookies, is governed by the Privacy Policy, which is incorporated into these Site Terms by reference. In case of discrepancy regarding personal data matters, the Privacy Policy prevails.
General provisions, governing law and jurisdiction
10.1.Any tolerance by FXO of non-compliance does not constitute novation or waiver of rights. If any provision of these Site Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the affected provision shall be interpreted or replaced so as to preserve, to the extent possible, its original purpose.
10.2.These Site Terms are governed by the laws of the Federative Republic of Brazil. The courts of the Judicial District of São Paulo, State of São Paulo, are elected to resolve disputes arising from browsing the Site, except for the user's domicile courts where consumer protection legislation so provides.
10.3.These Site Terms may be made available in other languages as a courtesy. In case of discrepancy between versions, the Portuguese-language version prevails for all purposes.
